Human Rose is operated by George Falardeau, an individual doing business as Human Rose ("Human Rose," "we," "us," or "our"). These terms are an agreement between you and George Falardeau.
You must be at least 18 years old and able to form a binding agreement to use Human Rose. By using the app you're confirming that's true. You may not use Human Rose if you've been previously banned or removed from it, or if any applicable law prohibits you from using a service like this.
You're responsible for what happens under your account. Don't share your login, and let us know if you think someone else has access to it. You may not maintain more than one account, and you may not create a new account to get around a suspension or ban.
Human Rose is a place to stay close to real people through live voice-and-vapor calls and the roses you send each other. The following are not allowed, and we can suspend or ban an account for any of them — including through the automatic ghosting/reporting system described in the app:
You can report or block any user from their profile menu. We review reports and act on them — usually within 24 hours — by removing content, warning, suspending, or permanently removing accounts that break these rules. We may also remove content that breaks these rules without notice.
You keep ownership of what you write and record. By adding it to Human Rose, you're granting us a worldwide, non-exclusive, royalty-free license to store, host, back up, and show it to a match or friend as the app is designed to — never to anyone else, and never before a mutual match. This license lets us run and maintain the service (including things like backups and content moderation review); it isn't a license to sell your content or use it for advertising. If you delete your account, we'll delete your content going forward, but a copy that a match or friend already received (for example, in a message thread) may still exist on their side, the same as a text message would after you delete the app that sent it.
Human Rose does its best to connect a live call reliably and to deliver your roses and messages, but we can't guarantee a successful connection, delivery, or that either person will be who or what they present themselves as.
Human Rose does not conduct criminal background checks, identity verification, or any screening of users beyond what's described elsewhere in these terms and our Privacy Policy. Meeting anyone from the internet — including anyone you meet through Human Rose, whether the interaction stays online or moves to an in-person meeting or call — carries real risk. You are solely responsible for your own safety and judgment in every interaction with another user, and you assume all risk arising from those interactions. We strongly encourage meeting in public places, telling a friend where you're going, and using ordinary caution, but we are not responsible for the conduct, online or offline, of any user.
Human Rose Plus is an auto-renewing subscription purchased through the Apple App Store or Google Play, not directly from us. Your purchase, billing, renewal, and cancellation are handled entirely by Apple or Google under their own terms — manage or cancel your subscription from your Apple ID or Google Play account settings, not in Human Rose itself. Refunds are issued by Apple or Google according to their own policies; we don't have the ability to issue refunds directly. Prices are shown in the app before purchase and may change for future billing periods with notice as required by the applicable store's rules.
Human Rose relies on services we don't operate ourselves — including Google Firebase/Google Cloud (hosting), OpenAI (matching and photo checks), Cloudflare (call relay), RevenueCat (subscriptions), Expo (notifications), and Sentry (crash reports), the video players of YouTube, Vimeo, and Instagram, and Apple's and Google's own platforms and payment systems. When you watch or share a YouTube video in Human Rose, you also agree to be bound by the YouTube Terms of Service. We aren't responsible for outages, errors, delays, or changes caused by these third parties, though we'll do what we reasonably can to keep the app working if one of them has a problem.
You can stop using Human Rose and delete your account at any time from Account & Privacy. We can also suspend or terminate an account that violates these terms or that we believe puts another person at risk, with or without notice.
Human Rose is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent the law allows — including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, Human Rose and George Falardeau will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the app — even if we've been advised of the possibility of those damages. Our total liability to you for any claim arising from these terms or your use of Human Rose is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) one hundred U.S. dollars ($100).
Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limits may not apply to you. Nothing in these terms limits liability that can't be limited under applicable law.
You agree to defend, indemnify, and hold harmless Human Rose and George Falardeau from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising from your use of Human Rose, your violation of these terms, or your violation of any right of another person, including anything that happens during or as a result of a meeting or interaction with another user.
We may update these terms as Human Rose develops. If a change is material, we'll do our best to let you know in the app before it takes effect. Continuing to use Human Rose after a change means you accept the updated terms.
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
Most concerns can be resolved by reaching out to us directly first at hello.boonapp@gmail.com — please try that before starting a formal dispute.
For anything that can't be resolved that way: you and Human Rose agree that any dispute arising from these terms or your use of Human Rose will be resolved by binding, individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small claims court if it qualifies. There is no right or authority for any dispute to be brought as a class, collective, or representative action, and both of us waive any right to a jury trial. This arbitration agreement is intended to be interpreted broadly, but if any part of it is found unenforceable, the rest of it still applies.
You may opt out of this arbitration agreement by emailing hello.boonapp@gmail.com with your name and a clear statement that you're opting out, within 30 days of the date you first agreed to these terms. Opting out doesn't affect any other part of these terms.
If you downloaded Human Rose from the Apple App Store, the following additional terms apply and are between you and us, not Apple:
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these terms isn't a waiver of it. These terms, along with our Privacy Policy, are the entire agreement between you and us about Human Rose, and replace any earlier agreements on the same subject. Neither of us is responsible for a delay or failure caused by something reasonably beyond our control.
